In our Spotlight on APAC series we round up the latest immigration developments from across the region. In this post we focus on Australia’s generous changes to the Subclass 482 & 494 Visa Conditions
Key changes implemented 1 July 2024
Holders of Subclass 482 Temporary Skill Shortage and 494 Skilled Employer visas now have up to 180 days at a time or a maximum of 365 days in total to apply for a different visa or arrange to depart Australia once they stop working with their current sponsorship.
Who it applies to
The changes apply to existing visa holders as well as those granted a visa on or after 1 July 2024
What is the impact?
The visa holders can work for other employers during this time, provided they have ceased work for original employer, unless otherwise exempt. and it includes occupations that are not listed in their most recent approved sponsorship nomination. This is to ensure the visa holder can support themselves whilst they look for a new sponsor.
If there is any change in the visa holders situation, they must advise the Immigration Department of Home Affairs of any changes, this includes ceasing sponsorship or if a visa holder resigns. Sponsors have 28 days to notify the Department of Home Affairs if there are any changes to the employment situation. This includes if the visa holder resigns or there is a change in the sponsorship status. We can contact the Department of Home Affairs on your behalf.
