Malaysia: New Document Requirement for Employment Pass Change of Category Applications

In our spotlight on the APAC series, we round up the latest developments across the Asia Pacific. In this post, we look at the update on the Malaysian Immigration Department new requirement for change of pass category.

Effective from 1st January 2025, the Malaysian Immigration Department will require employers or companies to submit a ‘’change of category letter’’ for foreign nationals that are changing Employment Pass categories (categories 1, 2 or 3). This letter must be submitted during the approval stage of the application. A sample letter can be found on the Malaysia Digital Economy Corporation website.

This new requirement is part of the recently implemented process where employers must cancel the existing foreign nationals Employment Pass when they are applying for a change of categories.

Employment Pass Categories

 

Category I

Key post positions in a company, such as executives, CEOs, technical or managing directors, project managers etc.

·         You must have a monthly salary of at least RM10,000.

·         You must have a work contract of up to five years.

·         The EP can be renewed.

·         You are allowed to hire a Foreign Domestic Helper.

Category II

Managerial and professional positions in a company, such as a marketing or investment manager, lecturers, directors, architects, etc.

·         You must have a salary between RM5,000 and RM9,999.

·         You must have a work contract of up to two years.

·         The EP can be renewed.

·         You are allowed to hire a Foreign Domestic Helper.

Category III

Non-executive positions in a company that require significant work experience and specific technical or practical skills. For example, designers (fashion, manufacturing, furniture), craftsmen, food technologists, etc.

·         You must earn a monthly salary between RM3,000 and RM4,999.

·         You must have a work contract of up to two years.

·         The EP cannot be renewed more than two times.

·         You are not allowed to hire a Foreign Domestic Helper.
