UK Immigration: The English language requirement subjective approach to an objective system

Passing an English language test from a UK Border Agency approved provider may not automatically remove the English language obstacle on migrants under Tiers 1, 2, 4 or spouse/partners (settlement) categories. The UKBA has recently suggested that staff at UK Border Control will be able to use their discretion, through interviews held at the port of entry, to decide whether they believe a migrant’s English language ability is at an “acceptable” level before granting entry to the UK (despite the migrant having already successfully proven their English language ability when applying for their visa).
