CG v Facebook Ireland Ltd and another  NIQB 11, 20 February 2015
The plaintiff was a former sex offender who brought a claim for misuse of private information and harassment against the defendants. The second defendant, Mr McCloskey, had identified the plaintiff on a facebook page called ‘Keeping our Kids Safe from Predators’, and also on the page of a third party.
The Northern Irish High Court found that Mr McCloskey was liable to the plaintiff on the grounds of misuse of private information and harassment. The first defendant, Facebook Ireland Ltd, was liable for misuse of private information from the date of receiving letters from the plaintiff’s solicitors until the date the offending material was taken down. Facebook Ireland Ltd’s defence that they did not have the necessary resources to remove the material was rejected by the court.
