Right to Erase-ya

An out of court settlement has been reached between a businessman and one of the largest online search engines before the High Court could hear the claim.

The businessman had been granted permission by the court back in July 2014 to bring a claim for injunctive relief against defamatory online postings about him which had appeared in the search engine’s search results, but at a subsequent hearing, the court was informed that the parties had already reached a settlement.

One negative arising from the settlement is that the High Court did not have the opportunity to consider an individual’s right to prevent the appearance of certain abusive online material about them appearing in online search results, which may subsequently have had significant implications for other search engines.
