PBS SPONSORSHIP SUCCESS STORIES
All UK based employers who employ or are considering employing foreign nationals should register as a sponsor with the UK Border Agency (UKBA) under Tier 2 of the Points Based System.
Obtaining a Licence is a complex process that requires detailed information and documentation to be provided to UKBA to satisfy the authorities that the employer is a bona fide organisation with the ability to take responsibility for ensuring legal right to work and sponsorship duties for all employees.
Applicant organisations are required to show that they have processes in place to guarantee compliance with myriad legal obligations within the UK Immigration Rules and published policies.
This includes providing evidence of Human Resource systems which enable employers to monitor migrant workers and report any changes to their circumstances.
Applications for registration involve the filing of an application online followed by the submission of original supporting documentation. Following this, UKBA officials may visit employer premises to interview relevant company officers and to inspect HR record keeping.
The immigration department at Magrath LLP has achieved a large number of successful licence registrations for businesses of all sizes and we have a very good understanding of UKBA's expectations. This enables us to provide detailed guidance on the required monitoring systems and reporting processes that employers must have in place in order to qualify for the licence. We are also able to prepare our clients for official site inspections and audits of HR records.
Once a licence has been obtained, UKBA officials can visit licensed sponsors premises at any time to undertake further audits and our team has expensive experience in the procedures that are followed.
