Updated Maintenance requirements for Tier 2 workers

The UK Border Agency has provided revised guidance on the maintenance requirements for Tier 2 workers. UKBA will no longer insist upon the worker holding £800 for the three months immediately prior to the application where an A-rated sponsor makes a payment of £800 into the applicant’s account.

Where an A-rated sponsor makes such a payment, there is no requirement that the sum has to have been in the worker’s account for three months. Evidence to support the payment to the worker will be sufficient.

It is still open for workers to show evidence of their own funds but they will have to do so for the three months prior to the application and the account must hold £800 throughout that period. The following will be accepted by UKBA:

  • ersonal bank or building society statements covering the three month period immediately before the application
  • Building Society pass book covering the previous three month period
  • Letter from a bank confirming funds and that they have been in the account for at least three months
  • Letter from a financial institution regulated by the FSA confirming funds and that they have been held for at least three months

This amendment applies only to the worker. Dependents will still have to demonstrate that they have £533 at their disposal for at least three months. It is though hoped that this amendment will assist employers who are A-rated sponsors to still employ migrant workers.
