Abusing ex-employees is still misconduct

Just when HRspy starts to think that nothing of interest is happening and wondering whether sanity is finally starting to reign in the UK’s workplaces, along comes a gem. An employee who, in all seriousness, attempts to defend allegations of gross misconduct involving the most serious racial abuse with …… “It can’t be misconduct because the [unprintable description of victim of abuse] doesn’t work here anymore”! The fact that the racial abuse took place in the foyer of the workplace and was complained about by other employees that overheard it is apparently “not relevant”. The grounds of appeal against dismissal should be interesting!
