According to reports, a spokesman for the Department for Business, Innovation and Skills (BIS) has confirmed that draft changes to TUPE are due to be revealed next month. These will then be laid before parliament in December 2013 with a view to them being implemented in January 2014. However, this timetable is not yet finalised and may be subject to change.
The proposed changes to TUPE are expected to include the removal of the conditions relating to service provision changes, a removal of the requirement to provide employee liability information and a change to the definition of “economic, technical or organisational reason entailing changes in the workforce” to include a change in the location of a workforce.
