    NEW LEGISLATION IN FORCE TODAY

    With the first of this year’s key dates for the implementation of employment legislation upon us today, a raft of new employment legislation has come into force.  Some of the key changes include:

    - Information and Consultation of Employees Regulations 2004 – the Regulations impose requirements on employers to inform and consult with employees in relation to a number of workplace and business issues.

    - Statutory Maternity Pay (General) (Amendment) Regulations 2005 – mothers in receipt of maternity pay will now benefit from pay rises awarded during maternity leave.

    - Statutory Maternity Pay (General) Regulations 2005 and Statutory Paternity Pay and Statutory Adoption Pay (General) (Amendment) Regulations 2005 – for the purposes of calculating Statutory Maternity, Adoption and Paternity Pay, an individual’s continuity of employment will not be affected by any reinstatement or re-engagement arising from a dispute resolution procedure (see Employment Act 2002 (Dispute Resolution) Regulations 2004).

    - Employment Relations Act 2004 – provides for enhanced protection from detrimental treatment for employees taking lawful industrial action, and introduces protection from detrimental treatment for employees absent from work on jury service. 

    - Pensions Act 2004 – entitles employees subject to a TUPE transfer to have an occupational pension scheme provided by the employer to whom they are transferred.
